Said section 1 of said chapter 121B, as so appearing, is hereby further amended by inserting after the definition of “Operating agency” the following definition:- “Person of low income with disabilities”, a person whose annual net income is less than the amount necessary to enable such person to maintain decent, safe and sanitary housing and who have been determined, pursuant to regulations issued by the secretary of housing and livable communities, to have an impairment that is expected to be of long, continued and indefinite duration, which substantially impedes the ability of such person to live independently in conventional housing and that is of such a nature that such ability could be improved by more suitable housing conditions; provided, however, that except as required by federal law and notwithstanding any other general or special law to the contrary, a history of alcohol or substance use shall not constitute a qualifying impairment; provided further, that eligibility for protection as a person with a disability under state or federal anti-discrimination laws shall not constitute a guarantee of eligibility for housing as a person of low income with a disability; and provided further that a person who has a disability as defined in paragraph 17 of section 1 of chapter 151B shall still be required to meet the definition of “a person of low income with a disability” under this section in order to be eligible for housing under this chapter.
