Subsection (e) of section 9D of chapter 118E of the General Laws, as appearing in the 2022 Official Edition, is hereby amended by adding the following new paragraph:- (7) In contracting with a nursing home licensed under section 71 of chapter 111, any MassHealth senior care options program with which the department or division contracts to provide and coordinate services on a capitated basis shall reimburse the nursing home for care and services provided to a MassHealth member at an amount not less than the current applicable Medicaid fee-for-service payment rate established under 101 CMR 206; provided, however, that such reimbursement payments shall include room and board and all rate add-ons specified pursuant to 101 CMR 206 for the purposes of ensuring access to critical services and facilitating transitions from hospitals to nursing facilities.
